South Dakota defines medical/infectious waste in broad terms that imply any waste created through the diagnosis, treatment, and immunization of humans or animals, including related research. Know the rules
South Dakota’s Department of Agriculture and Natural Resources (SDDANR) regulates waste management processes in the state. The hazardous waste section oversees treatment, storage, transport, and disposal of such waste.

Additional hazardous waste regulations are found in the administrative rules of the state under ARSD Chapter 74:20. South Dakota has adopted the federal CFR Title 40 Parts 260 through 279 as a primary guiding legislation for hazardous waste management.
Part 260 covers the rules of the EPA and contains valuable information for hazardous waste generators, such as determining waste classification.
Part 261 offers guidance on Identification of Hazardous Waste.
Part 262 provides information regarding Standards Applicable to Generators.
Part 272 provides guidance for Approved State Hazardous Waste Management Programs.

Regulations for hazardous waste pharmaceuticals are found in AR 74:28:27:01, enforced by South Dakota’s DANR’s Natural Resources Hazardous Waste Program.
South Dakota’s e-Manifest tracking system
South Dakota electronically tracks hazardous waste shipments and provides oversight for accessing the system and licensing rules for hazardous waste generators.
Know your hazardous waste generator status. Small quantity generators (SQG) of hazardous waste are required to notify the state of any change in generator status to either a very small quantity generator (VSQG) or a large quantity generator (LQG). You can use EPA Form 8700-12 for notification.
South Dakota adopted the Pharmaceutical Waste and P075 Listing amendment in 2019, banning disposal of hazardous waste pharmaceuticals in sewers, pouring down drains, or by flushing.
