For example, Title 33 covers topics of the Department of Environmental Quality. Topics are very detailed. For example, Title 33-20-12-02 states that sharps must be “separated from other regulated infectious waste, disinfected onsite, rendered nonsharp onsite” prior to disposal
North Dakota’s Environmental Quality Department (NDEQD) oversees the state’s hazardous waste program, which regulates generation, storage, treatment, transportation and disposal of hazardous waste. The NDEQD follows the requirements of the Resource Conservation and Recovery Act (RCRA).
North Dakota makes available a publications such as pharmaceutical waste guidance that aids in the identification, types, and characteristics of hazardous waste and information regarding hazardous waste generator standards.
The state follows the guidelines of the Code of Federal Regulations (Title 40) in regard to environmental protection and handling of medical waste. For example, infectious waste is to be placed into distinctive red containers or bags which are puncture and tear resistant. All such waste must also be labeled with the universally recognized biohazard symbol along with the word “Biohazard”.
Hazardous waste in any container or tank must be labeled as “Hazardous waste” and labels that indicate the contents.
Review of another DEQ document “A Guide to Understanding North Dakota’s Infectious Waste Regulations” is another valuable resource. The state’s administrative code Chapter 33.1-20-12 (Regulated infectious waste) covers definitions, management standards, and requirements for record-keeping.
Waste generators
Accurate determination of generator status is required and inspections are to be conducted to confirm appropriate classifications. Small and large quantity generators are required to submit biennial reports to the North Dakota DEQ every two years.
It is the responsibility of the waste generator to determine if any of their waste is hazardous. Categories range from very small quantity generator to large quantity generators.
