Who makes the rules in Nebraska?

The Department of Environment and Energy (DEE) provides guidance on infectious waste disposal processes, but knowing where to look and how to interpret regulations is vital for waste generators that produce hazardous waste, pharmaceuticals, or medical waste.

Knowing where to look for criteria of waste streams and their management is important for compliance. Nebraska waste generators are responsible (and required) to determine if their waste is hazardous in nature (Title 128, Chapter 4, §002).

Partnering with a reputable and knowledgeable waste management company with years of experience is essential in understanding requirements for a DEQ/EPA Identification Number and when such documents must be filed. It is your responsibility as a waste generator to notify the state of regulated waste activity.

Nebraska also follows the regulations of the Department of Transportation (DOT) regarding EPA hazardous waste numbers, hazard class determination, and quantity of waste shipped off-site. (Title 128, Chapter 4, §005.01A5)

Be aware that hazardous waste generators who accumulate more than 2.2 pounds of acute hazardous waste in a single month are regulated as a Large Quantity Generator (LQG).

According to the DEE, infectious wastes must be rendered non-infectious by approved methods in the state, which include incineration and/or autoclaving prior to disposal in a solid waste disposal area.

Nebraska’s hazardous waste regulations follow the guidelines of the Resource Conservation and Recovery Act (RCRA) of the Environmental Protection Agency for proper hazardous waste management processes.
