Regulations for potentially hazardous medical or industrial waste are not always easy to find. In Louisiana, several agencies oversee hazardous medical or industrial waste. Knowing what is applicable to your facility or business is vital. Issues such as storage limitations, labeling, permits, and verification of all waste streams generated at your place of business are essential to maintain compliance.

Who governs hazardous waste in Louisiana?

Regulations regarding hazardous waste management and processes in the state are primarily the purview of the Louisiana Department of Environmental Quality (LDEQ) and the state’s Department of Health. However, dozens of regulations can be found in Louisiana Administrative Code Title 33 Part 5 (Hazardous waste) that are especially important to review.

Louisiana’s DEQ website provides information regarding waste manifests and required forms by all hazardous waste generators. It takes some digging to find important information for small quantity generators of hazardous waste (Chapter 10, Subchapter A, §1003-§1017). Keeping accurate records is also mandated, as are annual reports (Subchapter B). 

Hospitals in the state must closely adhere to regulations for dealing with medical waste, especially when it comes to on-site hazardous waste storage or permitted disposal processes. All medical waste is to be treated prior to transport through approved methods such as autoclaving, incineration, or chemical disinfection. Approvals are handled by the Department of Health and Hospitals.

Louisiana defines a hazardous material per the Code of Federal Regulations (CFR 49 Part 172.101 – Purpose and use of hazardous materials table). Waste generators must follow rules regarding proper identification for hazard classes, packing groups, and proper shipping names for transportation.
